The account opens on the 8th July

and the items between that date and the 12th

have not been ticked off by Mr Nicolle, as all other entries

in the book have been.

From the enquiries I have made, from the appearance of the book, and from

all the circumstances of the case, I am of opinion that

Mr Nicolle is mistaken, and that he must have seen some

other books or accounts.

On the 12th July, ... ending and if he did not make a note

of the fact at the time, it is easy to be conceived that when he

came to draw up his report, ... statement that Mr. Bruce Shepherd told him that he had kept over

his various amounts in his own hands till the Bankrupt's stock was disposed of Mr. Nicolle has misunderstood Mr. Shepherd who could not have made such a statement, for there was no foundation for it.

The facts are as follows:-

Certain monies were paid to Mr Shepherd and these according to the Bank Paying Book were paid in as follows:-

11th July 888.37

20th July 247.03

27th July 149.

28th July 130.

8th August 152.28 $12.65

16th August ...

he may have made a mistake,

26th August 293.47

6th September 271.58

with respect to the statement ...
